The job reference is one of the most important references that you will receive in the course of your life, because you need it to apply for a new job. The choice of words and the omission of certain phrases are of great importance, because the employer could try to hide negative reviews in them. So you have to pay close attention to the content of every single certificate that you receive in the course of your professional life.

The employer is obliged to issue a truthful (ruling of the Federal Labor Court of June 23, 1960, 5 AZR 560/58) and benevolent (ruling of the Federal Court of Justice of November 26, 1963, 5 VI ZR 221/62). An estimated 15,000 disputes over employment references are brought before labor courts in Germany every year, and a reference language has developed.

These regulations hold a great deal of potential for conflict, because a boss naturally does not want to issue a good reference to an employee with whom he was not satisfied. For this reason, a so-called "testimonial language" has developed over time, in which supposedly "positive" formulations actually have a pejorative meaning. The most famous example is the phrase "he tried", which implies that he didn't make it.
